Simulator - Contribution for Economic Justice

Since January 1, 2025, before bringing certain proceedings before one of the twelve Economic Activities Courts selected as part of this experiment, the applicant must pay a contribution for economic justice (CJE).

From now on, the applicant must provide certain supporting documents with the initiating document so that the Commercial Court registry can calculate the amount of the CJE. Failure to pay the CJE is a ground for inadmissibility of the application, which the judge may raise ex officio. If the application is successful, the CJE will be reimbursed by default by the defendant, as a contribution to costs.

When the initial claim is filed by several claimants, the ECJ is payable by each of them, each according to the amount of the claims they have filed. Thus, the economic situation of each claimant will be analyzed, as well as the individual amount of damages, in order to determine the amount of the ECJ for each claimant. This means that it may be wise to integrate these issues when determining, if applicable, which entity to bring the dispute to within the same group.

In the event of multiple applicants, a simulation must be carried out for each of the applicant entities.
